Quit reponse to today's court orders in McCabe appeal

Quit Victoria is hoping for a positive outcome in the High Court, following the finalisation of the Court of Appeal's orders in the McCabe appeal.

Lawyers for Mrs McCabe’s estate indicated today that they intend to seek leave to appeal to the High Court, following the Court of Appeal ruling last week upholding British American Tobacco’s appeal against a damages award to Mrs McCabe in April.

In his original decision Justice Eames struck out British American Tobacco’s defence because it had destroyed thousands of documents about its business, thus denying Mrs McCabe a fair trial.

""We commend Mrs McCabe’s children for their determination to fight for justice for their mother, especially when they’re faced with such a powerful and well-resourced adversary.""

The Court of Appeal today ordered that the damages awarded to Mrs McCabe in April, including interest, be repaid to British American Tobacco, and also awarded costs in the tobacco giant’s favour.
